Welcome to the Institute for Humanity's Unified Development (IHUD) Terms of Use
Thank you for choosing to explore our website. The Institute for Humanity's Unified Development (IHUD), formerly known as INTEGRAL WORLD RESEARCH INSTITUTE ("IWRI"), is a non-commercial, not-for-profit organization dedicated to fostering a community committed to the holistic development of individuals and societies. These Terms of Use govern your access and use of IHUD's website, including www.ihud.world, www.ihud.ch and affiliated sites such as IHUD Channel, IHUD TV, IHUD International, IHUD Publication, IHUD Blog, and IHUD Books, along with associated social media outlets (collectively referred to as "website" or "websites") and the Services available through these Sites.
1. Agreement and Eligibility
This legally binding Agreement applies to all users, whether you are a "Visitor" or a "Member" (a registered user, including "Students" of IHUD, Education Center, or IHUD CH, Switzerland association). By accessing and/or using IHUD Services, you affirm your acceptance of this Agreement. Users must be 18 years or older, and their use of IHUD Services must comply with all Applicable Laws. IHUD reserves the right to delete profiles and terminate Membership for violations or misrepresentation of age.
2. Term and Termination
This Agreement remains in force during your use of IHUD Services or Membership. You may terminate your Membership at any time, following provided instructions. IHUD holds the right to terminate Membership with or without notice, and to deny, suspend, or terminate access, reassign, modify, or rename profiles. This Agreement remains effective even after Membership termination.
3. Fees
IHUD reserves the right to charge for certain Services and alter fees at its discretion. Notification of charges will be provided in advance, and charges will only apply with user consent. Membership termination due to a breach of this Agreement does not entitle a refund of unused fees or payments.
4. Password and Account Security
As a Member, you are responsible for password confidentiality. Do not disclose your password, and promptly report any unauthorized use. You are solely responsible for all account activities.
5. Use by Members
IHUD Services are for personal use, not for direct commercial purposes, and unauthorized commercial content may be removed. Illegal or unauthorized use, including collecting user information for unsolicited communication, is strictly prohibited. Any such activities may result in Membership termination and legal action.
6. IHUD Content and Services
6.1 IHUD Content: Proprietary Ownership and Restrictions
All content provided by IHUD ("IHUD Content") is the exclusive intellectual property of the Institute for Humanity's Unified Development. This includes, but is not limited to, text, graphics, logos, images, audio clips, digital downloads, and any other materials available on or through the IHUD Services.
IHUD retains full and unreserved ownership rights to all IHUD Content. IHUD Content" refers to any material, information, or creative work that is created, produced, or provided by the Institute for Humanity's Unified Development (IHUD). This can include, but is not limited to:
Textual content: Articles, blog posts, written materials, and any other written information.
Visual content: Images, graphics, photographs, and other visual elements.
Audio content: Recordings, podcasts, or any other auditory materials.
Video content: Recorded videos, presentations, or any other visual and auditory combined materials.
Software code: Any programming code, scripts, or software developed and owned by IHUD.
Other creative works: Any original content, materials, or intellectual property generated by IHUD.
In essence, "IHUD Content" encompasses the entirety of the intellectual property and creative output produced or owned by IHUD. This proprietary ownership is protected by copyright, trademark, patent, trade secret, and other applicable intellectual property laws. No transfer of ownership or intellectual property rights is granted to any user, Member, or third party.
Usage Restrictions:
You are granted a limited, revocable, non-sublicensable license to access and use IHUD Content solely for your personal, non-commercial use in connection with the IHUD Services. Any reproduction, distribution, modification, display, or creation of derivative works from the IHUD Content, in whole or in part, without explicit written consent from IHUD, is strictly prohibited.
No Right to Reproduce:
It is expressly prohibited to reproduce, duplicate, copy, sell, resell, or exploit for any commercial purpose any portion of the IHUD Content or Services without the prior written consent of IHUD. This prohibition extends to any unauthorized use, whether for personal gain or otherwise, and includes but is not limited to reproduction on external websites, publications, or any other medium. Unauthorized reproduction on external websites infringes on the exclusive rights held by IHUD, and violators may be subject to legal action.
Enforcement:
IHUD reserves the right to take legal action against any individual, entity, or third party found in violation of these ownership and usage restrictions. This may include seeking damages, injunctive relief, or any other available legal remedy. By accessing or using the IHUD Services, you acknowledge and agree to abide by these strict ownership and usage terms concerning IHUD Content. Any unauthorized use may result in termination of Membership and legal consequences.
6.2 User Content: The IHUD Services contain the Content of Users and other IHUD licensors. Except as provided within this Agreement, you may not copy, modify, translate, publish, broadcast, transmit, distribute, perform, display, sell, or otherwise use any Content appearing on or through the IHUD Services.
6.3 Technical Functions: IHUD performs technical functions necessary to offer the IHUD Services, including the processing and transmission of email communications and transcoding/reformatting Content. It means that IHUD engages in various technical operations to ensure the proper functioning of the IHUD Services. These operations include:
Processing and Transmission of Email Communications: IHUD handles the technical aspects of sending and receiving email communications related to the IHUD Services. This may involve tasks such as managing email servers, ensuring the delivery of messages, and processing incoming emails.
Transcoding/Reformatting Content: IHUD engages in technical processes to transcode or reformat content. Transcoding refers to the conversion of multimedia content (such as videos or images) from one format to another. Reformatting involves adjusting the structure or presentation of content to make it compatible or optimized for use within the IHUD Services.
You agree that IHUD may send messages, including notifications, special offers, promotions, commercial advertisements, and marketing materials.
6.4 Storage Limitations: IHUD reserves the right to limit the storage capacity of Content that you post on, though, or in connection with the IHUD Services.
7. Content Posted
7.1 IHUD may reject, refuse to post, or delete any Content for any reason, including violations of this Agreement or offensive material. IHUD assumes no responsibility for monitoring inappropriate Content but reserves the right to do so at its discretion.
7.2 Users are solely responsible for the Content they post and for interactions with other Users. All user-submitted content may be used by IHUD for various purposes, as outlined in this Agreement.
8. Content/Activity Prohibited
The following are examples of prohibited Content or activities on IHUD Services. IHUD reserves the right to investigate and take legal action against violators:
8.1 is patently offensive or promotes or otherwise incites racism, bigotry, hatred, or physical harm of any kind against any group or individual;
8.2 harasses or advocates harassment of another person;
8.3 exploits people in a sexual or violent manner;
8.4 contains nudity, excessive violence, or offensive subject matter or contains a link to an adult website;
8.5 solicits or is designed to solicit personal information;
8.6 publicly posts information that poses or creates a privacy or security risk to any person;
8.7 constitutes or promotes information that you know is false or misleading or promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory, or libelous;
8.8 constitutes or promotes an illegal or unauthorized copy of another person's copyrighted work, such as providing pirated computer programs or links to them, providing information to circumvent manufacturer-installed copy-protect devices, or providing pirated music or links to pirated music files;
8.9 involves the transmission of "junk mail," "chain letters," or unsolicited mass mailing, instant messaging, "spamming," or "spamming";
8.10 contains restricted or password-only access pages or hidden pages or images (those not linked to or from another accessible page);
8.11 furthers or promotes any criminal activity or enterprise or provides instructional information about illegal activities including, but not limited to, making, or buying illegal weapons, violating someone's privacy, or providing or creating computer viruses;
8.12 solicits or is designed to solicit passwords or personal identifying information for commercial or unlawful purposes from other Users;
8.13 involves commercial activities and/or sales without prior written consent from IHUD such as contests, sweepstakes, barter, advertising, or pyramid schemes;
8.14 includes a photograph or video of another person that you have posted without that person's consent;
8.15 violates or attempts to violate the privacy rights, publicity rights, copyrights, trademark rights, contract rights or any other rights of any person.
8.16 using the IHUD Services in a manner inconsistent with any and all Applicable Law.
9. Protecting Copyrights and Other Intellectual Property
IHUD respects intellectual property rights. Users may not upload, embed, post, email, transmit, or otherwise make available any material that infringes on the rights of others.
10. Third-Party Linked Services
10.1 IHUD maintains no affiliation with any third-party programs or organizations.We do not form partnerships or maintain special relationships with any ad server companies.
10.2 Use of Third-Party Content
Some video footage and images used in our creative productions are sourced from Pexels (www.pexels.com), Pixabay (www.pixabay.com), and Wix (www.wix.com). Our sincere gratitude goes to the talented photographers and videographers from the Pexels, Pixabay, and Wix communities who generously shared their work under the Creative Commons Zero (CC0) license. The use of content from Pexels, Pixabay, and Wix complies strictly with their respective licensing terms, and we adhere to proper attribution guidelines as specified by Creative Commons. The contributions from these platforms significantly enhance the visual quality of our non-profit video, and we deeply appreciate the creative community's generosity in making such content freely available.
11. Member Disputes
You are solely responsible for your interactions with other IHUD Users, third-party developers, or any other parties with whom you interact through the IHUD Services and/or Linked Services. IHUD reserves the right, without obligation, to become involved in any way with these disputes.
12. Privacy
Use of the IHUD Services is also governed by our Privacy Policy, which is incorporated into this Agreement by reference.
13. Disclaimers
IHUD is not responsible for and provides no warranties, express or implied, as to the User Content or the accuracy and reliability of User Content posted through or in connection with the IHUD Services or Linked Services. User Content does not necessarily reflect the opinions or policies of IHUD. Additionally, IHUD is not responsible for any damage, injury, or loss caused by Users of the IHUD Services or by any equipment or programming associated with or utilized in the IHUD Services or Linked Services.
Profiles and Linked Services created and posted by Members on, through, or in connection with the IHUD Services may contain links to other websites or services. IHUD is not responsible for the Content, accuracy, or opinions expressed on such websites and services. These external websites and services are not necessarily investigated, monitored, or checked for accuracy or completeness by IHUD. Inclusion of any linked website or service on the IHUD Services does not imply approval or endorsement of the linked website or service by IHUD. Users access these third-party sites and services at their own risk. IHUD takes no responsibility for third-party advertisements or Linked Services posted on, through, or in connection with the IHUD Services or Linked Services, nor does it take responsibility for the goods or services provided by these third parties. IHUD is not responsible for the conduct, whether online or offline, of any User of the IHUD Services or Linked Services. IHUD assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft, or destruction, or unauthorized access to, or alteration of, any User or Member communication. IHUD is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any email or players due to technical problems or traffic congestion on the Internet or on any of the IHUD Services or Linked Services or a combination thereof, including, without limitation, any injury or damage to Users or to any person's computer related to or resulting from participation or downloading materials in connection with the IHUD Services or Linked Services. Under no circumstances shall IHUD be responsible for any loss or damage, including, without limitation, personal injury, or death, resulting from the use of the IHUD Services or Linked Services, attendance at an IHUD event, from any User Content posted on or through the IHUD Services or Linked Services, or from the conduct of any Users of the IHUD Services, whether online or offline. The IHUD Services and Linked Services are provided "AS IS" and as available, and IHUD expressly disclaims any warranty of fitness for a particular purpose or non-infringement. IHUD cannot guarantee and does not promise any specific results from the use of the IHUD Services or Linked Services.
14. Limitation on Liability
IN NO EVENT SHALL IHUD BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING, WITHOUT LIMITATION, LOST PROFIT DAMAGES ARISING FROM YOUR USE OF THE IHUD SERVICES OR LINKED SERVICES, EVEN IF IHUD HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, IHUD'S LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO IHUD FOR THE IHUD SERVICES DURING THE TERM OF MEMBERSHIP AND THEREAFTER.
15. Disputes
The Agreement shall be governed by, and construed in accordance with, the laws of Switzerland, without regard to its conflict of law provisions. You and IHUD agree to submit to the exclusive jurisdiction of the courts located within Geneva to resolve any dispute arising out of the Agreement or the IHUD Services.
EACH OF THE PARTIES HEREBY KNOWINGLY, VOLUNTARILY, AND INTENTIONALLY WAIVES ANY RIGHT IT MAY HAVE TO A TRIAL BY JURY IN RESPECT OF ANY LITIGATION ARISING OUT OF, UNDER OR IN CONNECTION WITH THIS AGREEMENT. FURTHER, EACH PARTY HERETO CERTIFIES THAT NO REPRESENTATIVE OR AGENT OF EITHER PARTY HAS REPRESENTED, EXPRESSLY OR OTHERWISE, THAT SUCH PARTY WOULD NOT IN THE EVENT OF SUCH LITIGATION, SEEK TO ENFORCE THIS WAIVER OF RIGHT TO JURY TRIAL PROVISION. EACH OF THE PARTIES ACKNOWLEDGES THAT THIS SECTION IS A MATERIAL INDUCEMENT FOR THE OTHER PARTY ENTERING INTO THIS AGREEMENT.
16. Indemnity
You agree to indemnify and hold IHUD, its subsidiaries, and affiliates, subcontractors, and other partners, and their respective officers, agents, partners, and employees, harmless from any loss, liability, claim, or demand, including, but not limited to, reasonable attorneys' fees, made by any third party due to or arising out of your use of the IHUD Services in violation of this Agreement and/or arising from a breach of this Agreement and/or any breach of your representations and warranties set forth in this Agreement and/or any Content that you post on, through, or in connection with the IHUD Services.
17. Disclaimer
This site is protected under international intellectual property laws. Any printing, modifying, reproduction, copying, transmission, publication, distribution, performing, broadcast, making available to the public, alteration, license, hyperlink, creation of derivative works, or any other use of materials contained therein in any manner is strictly prohibited unless expressly and specifically permitted in writing on this site. Without derogating from the above, all copyrights, texts, names, graphics, logos, trademarks, service marks, images, pictures, photos, designs, sound recordings, and other content and works contained on this site are owned and/or used under authorized license by "IHUD – Institute for Humanity's Unified Development, including www.glue.education," and are subject to the protection of international copyright laws. Any visitor to this site is allowed only for browsing and/or accessing its resources.
18. Other
This Agreement is accepted upon your use of the IHUD Website or any of the IHUD Services and is further affirmed by you becoming a Member. Your agreement with IHUD will always include this Agreement at a minimum. Your access and use of certain IHUD Services will require you to accept additional terms and conditions applicable to such certain IHUD Services, in addition to this Agreement, and may require you to download Software or Content. The failure of IHUD to exercise or enforce any right or provision of this Agreement shall not operate as a waiver of such right or provision. The section titles in this Agreement are for convenience only and have no legal or contractual effect. IHUD is a trademark of IHUD, Inc. This Agreement operates to the fullest extent permissible by law. If any provision of this Agreement is unlawful, void, or unenforceable, that provision is deemed severable from this Agreement and does not affect the validity and enforceability of any remaining provisions.
